General terms and conditions of business.

§ 1 Scope, subject matter and conclusion of the respective contract

(1)  The following conditions conclusively regulate the contractual relationship between the seller Melanie Mirabel Jewellery, owner: Melanie Mirabel with  Company headquarters in Berlin and owner of the webshop www.melaniemirabel.com and the buyer. Deviating and/or other agreements require written confirmation by the seller.

(2) These general terms and conditions form part of every contractual agreement between the provider and the respective customer. Conflicting general terms and conditions of the customer are hereby rejected.

§ 2 – Offer of goods and conclusion of contract

(1) The provider offers the products in the online shop www.melaniemirabel.com the goods shown for sale.  The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order. Color variations may occur due to different monitor settings. Since the items are handmade, variations and deviations in appearance are possible in rare cases.

(2) The provider delivers from its location in Berlin to Germany, Austria and Switzerland and, upon request, to all other countries of the European Union and outside the EU.

(3) The customer can use the seller’s website www.melaniemirabel.com place an order for the goods. By submitting the order request using the "Order with payment" button, the purchaser accepts the purchase offer. The provider confirms the conclusion of the contract by email (contract confirmation).

(4) The content of concluded contracts will be stored by the provider and sent to the customer via email in the contract confirmation. The customer is recommended to print out this email or otherwise retain it.

(5) In the event of delivery impediments or other circumstances that would prevent the fulfilment of the contract, the provider will inform the customer by email.

(6) The customer will regularly receive an email from the seller with the current status of his order.

§ 3 – Prices and payment

(1) The provider delivers after receipt of payment. The customer selects the payment method at the time of purchase. The provider offers the payment methods PayPal, bank transfer and Credit card. 

(a) For the payment method “PayPal”, the customer will first be redirected to an external website of PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), where the customer enters his PayPal details and thereby initiates the payment.

(b) For the "credit card" payment method, the customer will be redirected to the payment provider's website, where they will enter their credit card details (Visa, Mastercard, etc.), from which the payment amount will then be debited. The payment information is 100% secure.

(2) For deliveries outside the European Union, customs duties and import sales tax may apply, which must be paid by the customer to the customs authorities upon receipt of the shipment. These duties are charged in addition to the purchase price and shipping costs and are beyond the control of the provider.

(3) All prices quoted are in euros and include statutory VAT. Postage and packaging costs will be added in accordance with the separate payment terms.The prices from the current offer always apply.

§ 4 – Shipping, delivery times

1) The seller will deliver the goods after receipt of payment - as detailed in the “Shipping and Payment” section.

(2) The shipping times and shipping prices are also shown in the “Shipping and Payment” section.

(3) Several products ordered at the same time will be delivered in one shipment.

(4) If the customer is responsible for the undeliverability of a shipment (z.B. if the customer has provided an incorrect or incomplete delivery address), a second delivery attempt will only be made if the customer covers the costs of the second delivery. The additional shipping costs correspond to the shipping costs agreed upon at the time of conclusion of the contract. The provider will inform the customer of the necessary costs for a second delivery via email. A second delivery will only be made after receipt of payment of these costs.

§ 5 – Consumer right of withdrawal/warranty, liability for defects


Please note that according to the general terms and conditions, personalized jewelry that has been individually crafted and engraved for you is not eligible for return or exchange. 

In case of defective delivery or any other complaint, please send us a message within 3 days of receipt to hello@melaniemirabel.com zu to handle and process the complaint or cancellation request directly and personally. We are happy to offer customer-friendly solutions and are happy to discuss any complaint personally with the customer in advance. 

The following general rules apply:

(1) A customer who purchases as a consumer is entitled to a right of withdrawal in accordance with the statutory provisions. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

(2) To exercise the right of withdrawal, the buyer must, by means of an unambiguous declaration (z.B. a letter sent by post or email) to inform the seller.

(4) The Buyer must return the Goods to the Seller promptly and in any event no later than 14 days from the day on which the Goods were delivered. 

(5) For returns from Germany, we charge €5 for the shipping label. For returns from Switzerland and international returns, we charge €15. 

(6) The buyer shall bear the costs of return shipping. 

§ 6 – Data protection information

(1) The provider collects and processes the data entered by the customer during the purchase process for the purpose of processing and fulfilling the contract. This includes, in particular, the customer's name, address, and email address. If the customer has provided further data during the order process (z.B. a different delivery address or a telephone and/or fax number), these will also be transmitted.

(2) The provider processes the data referred to in paragraph 1 electronically for the proper performance of the contract, in particular for shipping, invoicing, and the recording of payments. For the purpose of shipping, the provider may also transmit the customer's data referred to in paragraph 1 to the commissioned shipping company.

(3) The provider will keep the data stored until all mutual claims arising from the order have been fully settled and the provider’s commercial and tax retention obligations have expired.

(4) If the customer uses the PayPal service for payment, the PayPal privacy policy also applies to the payment process.PayPal acts as the customer's agent, not the provider's. If the customer chooses the "purchase on account" payment method via PayPal Plus, they will be asked during the ordering process to consent to the transmission of the data required for processing the payment and an identity and credit check to PayPal. If they consent, this data will be transmitted to PayPal. For the purpose of their own identity and credit check, PayPal or partner companies commissioned by PayPal transmit data to credit agencies and receive information from them, as well as, if applicable, credit information based on mathematical-statistical procedures, the calculation of which includes, among other things, address data.

(5) The customer may request information from the provider at any time about the data stored about the customer. Furthermore, the customer may request the correction of inaccurate data at any time.

(6) The responsible body for data protection is the provider named in Section 1 paragraph 1.
